These Terms & Conditions ("Terms") govern your access to and use of blackarcsystems.com and any pages, content, or features made available through it (the "Site"), operated by BlackArc Industrial, LLC, doing business as BlackArc Systems ("BlackArc," "we," "us," or "our").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms apply to website use only. The terms governing any service engagement are set out in the Master Services Agreement, Statement of Work, or order documents you sign with us, which control in the event of any conflict.

The Site is provided for general informational and business purposes. You may view, download, and print pages for your own internal, non-commercial reference, provided you do not remove any proprietary notices.

You agree not to: (a) use the Site in any way that violates applicable law or regulation; (b) attempt to gain unauthorized access to any portion of the Site, its servers, or connected systems; (c) probe, scan, or test the vulnerability of the Site or breach security or authentication measures; (d) use any automated means (scrapers, bots, crawlers) to access or harvest content except as permitted by our robots directives; (e) interfere with or disrupt the Site or the networks connected to it; or (f) use the Site to transmit malware or other harmful code.

All content on the Site — including text, graphics, layouts, logos, diagrams, illustrations, code, and the selection and arrangement thereof — is the property of BlackArc Industrial, LLC or its licensors and is protected by United States and international intellectual-property laws.

Except for the limited permitted use described above, no content may be copied, reproduced, republished, distributed, or used to create derivative works without our prior written consent.

"BlackArc Systems," "BlackArc," and "Federal AI, Built to Run" are marks of BlackArc Industrial, LLC or its affiliates. All other product names, logos, and brands referenced on the Site — including those of our partners and the OEMs whose technology we compose into systems — are the property of their respective owners and are used for identification and descriptive purposes only. Their use does not imply endorsement.

The Site may contain links to third-party websites and references to third-party products, programs, and certifications. We provide these for convenience and information only. We do not control and are not responsible for the content, policies, or practices of any third party, and a reference is not an endorsement.

Partner authorizations, program designations, and certifications referenced on the Site are accurate to the best of our knowledge as of publication and are subject to change at the discretion of the issuing organization.

Nothing on the Site constitutes an offer to sell, a quotation, or a binding commitment. Service descriptions, capabilities, statistics, and example outcomes are illustrative. Any engagement with BlackArc is governed exclusively by a separately executed agreement, which sets out scope, pricing, deliverables, warranties, and liability.

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any content is accurate, complete, or current.

TO THE FULLEST EXTENT PERMITTED BY LAW, BLACKARC INDUSTRIAL, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold harmless BlackArc Industrial, LLC and its affiliates from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or violation of these Terms.

Your use of the Site is also governed by our Privacy Policy, which describes how we collect and handle information. Please review it to understand our practices.

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Virginia for any dispute arising out of or relating to the Site or these Terms.

We may update these Terms from time to time. Changes are effective when posted, and the "last updated" date below will reflect the revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
